By accessing or using BUMPIn ("the Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

1. ACCEPTANCE OF TERMS

By creating an account, accessing, or using BUMPIn, you acknowledge that you have read, understood, and agree to be bound by:

These documents collectively constitute the entire agreement between you and BUMPIn.

2. ELIGIBILITY AND AGE REQUIREMENTS

2.1 Minimum Age

You must be at least 18 years of age to use this Service. By using BUMPIn, you represent and warrant that:

You are at least 18 years old
You have the legal capacity to enter into these Terms
You are not prohibited from using this Service under applicable law

2.2 Age Verification

We reserve the right to request proof of age at any time. Failure to provide such proof may result in immediate account suspension or termination.

2.3 Prohibition on Minors

NAPALM SKY IS STRICTLY PROHIBITED FOR USE BY ANYONE UNDER THE AGE OF 18. If we discover that a user is under 18, we will immediately terminate their account and may report the incident to appropriate authorities.

3. SERVICE DESCRIPTION

BUMPIn is a speed-dating platform that provides:

User Profiles: Upload of selfie photographs and introduction videos
Real-Time Matchmaking: Discovery of other users seeking connections
Video Chat: Peer-to-peer video communication via WebRTC technology
Referral System: Ability to introduce friends to other users
Call History: Records of past video conversations
Social Connection: Exchange of social media handles

4. ACCOUNT REGISTRATION AND TYPES

4.1 Account Types

Guest Accounts:

Temporary accounts valid for 7 days
Require only name and gender
Full access to platform features after verification

Permanent Accounts:

Long-term accounts requiring email and password
30-day session duration
Ability to recover account access

4.2 Account Information

You agree to:

Provide accurate and truthful information
Use your real name or a name you commonly go by
Maintain the security of your account credentials
Notify us immediately of any unauthorized access

4.3 One Account Per Person

You may only maintain one (1) active account. Creating multiple accounts to evade bans, abuse features, or manipulate the platform is strictly prohibited.

5. PAYMENT AND ACCESS VERIFICATION

5.1 One-Time Payment

Access to BUMPIn requires a one-time payment of $0.50 USD to verify account legitimacy and prevent bot activity.

5.2 Alternative Access

You may gain free access by:

Using an invite code from an existing verified user
Scanning a QR code provided by a friend

5.3 Payment Processing

Payments are processed securely through Stripe, a third-party payment processor. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy.

5.4 No Refunds

All payments are final and non-refundable. This applies whether you:

Choose to delete your account
Are banned from the platform
Experience technical difficulties
Change your mind about using the Service

Exception: Refunds may be issued at our sole discretion in cases of billing errors or technical failures that prevent service access.

5.5 No Recurring Charges

This is a one-time payment only. We do not charge subscription fees, and you will not be billed again unless you create a new account after deletion.

5.6 Invite Codes

Upon payment verification, you will receive four (4) invite codes that can be shared with friends for free access. You are responsible for how these codes are used.

6. USER CONTENT AND MEDIA

6.1 Required Content

To use the Service, you must provide:

Selfie Photograph: A clear photo of your face taken via webcam
Introduction Video: A video recording of yourself (5-60 seconds) taken via webcam with audio

6.2 Content Ownership

You retain ownership of all content you upload. By uploading content, you grant BUMPIn a non-exclusive, worldwide, royalty-free license to:

Store and display your content on the platform
Show your content to other users for matchmaking purposes
Use your content for platform operation and improvement

6.3 Content Standards

All uploaded content must:

Feature only you (no group photos)
Be appropriate for an 18+ dating platform
Not contain nudity, sexually explicit material, or obscene content
Not violate any third-party rights
Not contain hate speech, violence, or illegal activity

6.4 Video Chat Consent

By using the video chat feature, you acknowledge and consent that:

Other users will see and hear you via live video
You are in a private location appropriate for video communication
You will not record, screenshot, or capture content from video chats
Recording others without consent may be illegal in your jurisdiction

6.5 Prohibited Content

You may not upload or share:

Pornographic or sexually explicit material
Content depicting minors
Violent or disturbing imagery
Copyrighted material you don't have rights to
Content that impersonates others
Spam or commercial advertisements

7. USER CONDUCT AND PROHIBITED ACTIVITIES

7.1 Acceptable Behavior

You agree to:

Treat other users with respect
Be honest in your profile and communications
Use the platform for its intended dating/connection purpose
Follow all applicable laws and regulations

7.2 Prohibited Behavior

You may not:

Harass, threaten, intimidate, or abuse other users
Impersonate any person or entity
Use the platform for commercial purposes or solicitation
Share or request personal contact information in violation of our policies
Attempt to scam, defraud, or manipulate other users
Use automated systems (bots) to access the Service
Attempt to gain unauthorized access to any part of the Service
Reverse engineer, decompile, or attempt to extract source code
Interfere with or disrupt the Service or servers
Violate any local, state, federal, or international law

7.3 Sexual Misconduct

Any form of sexual harassment, unwanted sexual advances, or inappropriate sexual content during video chats is strictly prohibited and will result in immediate permanent ban.

8. REPORTING AND MODERATION SYSTEM

8.1 Reporting Users

After any video call, you may report another user for:

Inappropriate behavior or content
Harassment or abuse
Violations of these Terms
Any conduct that made you uncomfortable

8.2 Report Limits

You may report each user only once. False or malicious reporting is prohibited and may result in action against your account.

8.3 Automatic Ban System

IMPORTANT: If you receive four (4) or more reports from unique users, your account will be automatically temporarily banned pending administrative review.

8.4 Administrative Review

Our team will review all temporary bans. Following review, we may:

Uphold the ban permanently and add you to the public blacklist
Vindicate you and restore full access
Take other appropriate action

8.5 Ban Decision Final

All ban decisions are final and at our sole discretion. We are not obligated to provide detailed explanations or evidence.

9. PUBLIC BLACKLIST

9.1 Purpose

We maintain a public blacklist of permanently banned users to promote transparency and community safety.

9.2 Disclosure of Information

If you are permanently banned, the following information will be publicly displayed on our blacklist:

Your name (as provided in your profile)
Your profile photograph (selfie)
Your introduction video
Ban reason (general)
Number of reports received
Date of ban

9.3 Consent to Disclosure

BY USING THIS SERVICE, YOU EXPLICITLY CONSENT to the potential public disclosure of your profile information if you are permanently banned for violations of these Terms.

9.4 No Removal Right

Permanently banned users have no right to removal from the blacklist. This serves as a permanent public record of misconduct.

10. IP ADDRESS TRACKING AND ENFORCEMENT

10.1 IP Tracking

We automatically collect and store your IP address(es) for:

Security and fraud prevention
Ban enforcement
Compliance with legal requirements
Platform integrity

10.2 IP Bans

If you are banned, all IP addresses associated with your account will be banned from accessing the Service.

10.3 Ban Evasion

Attempting to evade a ban by:

Creating new accounts
Using VPNs or proxies
Using different devices

...is strictly prohibited and may result in legal action.

11. COOLDOWN SYSTEM

11.1 24-Hour Cooldown

After completing a video call with another user, a 24-hour cooldown period is automatically applied between you and that user.

11.2 Purpose

This prevents repeat matching and encourages diverse connections.

11.3 No Circumvention

Attempting to circumvent the cooldown system is prohibited.

12. REFERRAL SYSTEM

12.1 How It Works

You may generate unique referral links to introduce friends to specific users you've seen in matchmaking ("wingperson" or "matchmaker" feature).

12.2 Responsible Use

You are responsible for:

Only sharing referrals with people you know
Not spamming or publicly posting referral links
Ensuring referred users meet eligibility requirements

12.3 No Compensation

Referrals are for facilitating connections only. There is no monetary compensation for referrals.

13. DATA RETENTION AND DELETION

13.1 Chat History

We store records of your video chat sessions, including:

Participants
Duration
Timestamp

We do not record or store the actual video/audio content of your calls.

13.2 Account Deletion

You may delete your account at any time through settings. Upon deletion:

Your profile will be removed from matchmaking
Your personal information will be deleted within 90 days
Call history may be retained for analytics (anonymized)
If you were banned, your blacklist entry will remain

13.3 Data Portability

You may request a copy of your data by contacting us at everything@napalmsky.com.

14. INTELLECTUAL PROPERTY

14.1 Our Ownership

All aspects of the Service, including but not limited to:

Website design and layout
Source code and software
BUMPIn name, logo, and branding
Features and functionality

...are owned by BUMPIn and protected by copyright, trademark, and other intellectual property laws.

14.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

14.3 Restrictions

You may not:

Copy, modify, or create derivative works
Sell, rent, lease, or sublicense access
Use our branding without written permission
Remove or alter any proprietary notices

15. THIRD-PARTY SERVICES

15.1 Service Providers

We use third-party services including:

Stripe: Payment processing
Twilio: WebRTC TURN servers for video connectivity
Cloud hosting providers: Data storage and delivery

15.2 Third-Party Terms

Your use of these services is also subject to their respective terms of service and privacy policies.

15.3 No Endorsement

We do not endorse or control content shared by users or linked external services.

16. PRIVACY AND DATA PROTECTION

16.1 Privacy Policy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

16.2 Data Security

We implement reasonable security measures to protect your data, but we cannot guarantee absolute security. You use the Service at your own risk.

16.3 Breach Notification

In the event of a data breach affecting your personal information, we will notify you in accordance with applicable law.

17. DISCLAIMERS

17.1 AS-IS BASIS

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability
Uninterrupted or error-free operation

17.2 No Guarantee of Results

We do not guarantee that you will:

Find compatible matches
Form successful relationships
Have positive experiences with other users

17.3 User Interactions

WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF OTHER USERS. You interact with other users at your own risk. We do not conduct background checks or verify user information.

17.4 Technical Issues

We do not guarantee:

Continuous, uninterrupted access
Error-free operation
Compatibility with all devices
Availability of video chat features

18. LIMITATION OF LIABILITY

18.1 Disclaimer of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAPALM SKY SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Personal injury or property damage
Damages arising from interactions with other users
Damages from unauthorized access to your account

18.2 Maximum Liability

Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid to us ($0.50) or $100, whichever is greater.

18.3 State-Specific Rights

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

19. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless BUMPIn, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another
Your conduct or content
Your interactions with other users

20. DISPUTE RESOLUTION

20.1 Informal Resolution

Before filing a claim, you agree to contact us at everything@napalmsky.com to attempt to resolve the dispute informally.

20.2 Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law principles.

20.3 Arbitration Agreement

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration rather than in court, except that:

Either party may seek injunctive relief in court
Small claims court actions are permitted

20.4 Class Action Waiver

YOU AGREE THAT DISPUTES MUST BE BROUGHT INDIVIDUALLY and not as part of any class, consolidated, or representative action. Class arbitrations and class actions are not permitted.

20.5 Venue

If arbitration does not apply, you agree that any legal action must be filed in courts located in Los Angeles County, California.

21. MODIFICATIONS TO TERMS

21.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service.

21.2 Notice

We will provide notice of material changes via:

Email (if you provided one)
Prominent notice on the Service
In-app notification

21.3 Continued Use

Your continued use of the Service after changes constitutes acceptance of the modified Terms.

22. TERMINATION

22.1 Termination by You

You may terminate your account at any time by deleting it through settings.

22.2 Termination by Us

We may suspend or terminate your account immediately, without notice, for:

Violation of these Terms
Illegal activity
Abusive behavior
Receipt of multiple user reports
Suspected fraud or security risk
Any reason at our sole discretion

22.3 Effect of Termination

Upon termination:

Your right to access the Service immediately ceases
We may delete your account data
These Terms remain in effect for all previous use

23. GENERAL PROVISIONS

23.1 Entire Agreement

These Terms, together with the Privacy Policy and other incorporated documents, constitute the entire agreement between you and BUMPIn.

23.2 Severability

If any provision is found unenforceable, the remaining provisions shall remain in full effect.

23.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver.

23.4 Assignment

You may not assign these Terms. We may assign our rights to any affiliate or successor.

23.5 No Agency

No agency, partnership, joint venture, or employment relationship is created by these Terms.

23.6 Force Majeure

We are not liable for failures or delays due to circumstances beyond our reasonable control.

25. ACKNOWLEDGMENT

BY CLICKING "I AGREE," CREATING AN ACCOUNT, OR USING THE SERVICE, YOU ACKNOWLEDGE THAT:
